| Comments | Abstract: 2019年2月14日、札幌、東京、名古屋、大阪の裁判所で一斉に提訴された後、2019年9月には福岡の裁判所でも始まった「結婚の自由をすべての人に」訴訟は、法律上同性の者との婚姻を認めていない現行民法等の規定の不存在、すなわち、立法不作為の違憲性を正面から問う、日本で初めての訴訟です。2024年1月現在、札幌、東京、名古屋、大阪、福岡の５地裁で判決が言い渡されました。2021年に追加提訴した東京２次訴訟は、今年3月14日に判決の予定で、東京１次訴訟の東京高裁判決も今年中になされる見込みです。 本講演では、主に「結婚の自由をすべての人に」訴訟・東京訴訟の現状と今後について紹介する予定です。 Language: Japanese |
